The
Nevada Appeal Tribunal hearing creates the core record
Treat the hearing as the principal opportunity to present testimony,
exhibits, and objections on the issues listed in the Notice of
Hearing.
Begin with the noticed
issues
Create a separate section for each issue. A hearing may involve more
than the separation itself—for example, timeliness, ability and
availability, or overpayment.
Prepare the legal proof
For each issue:
identify the governing Nevada statute, regulation, and controlling
cases;
state who carries the burden;
list each element or decision factor;
connect testimony and exhibits to each factor;
identify adverse evidence; and
state the finding requested.
Exhibits
Follow the current Appeal Tribunal instructions for exchanging and
submitting exhibits. Be prepared to identify each document, explain its
source and relevance, and confirm whether it was admitted.
Witnesses and subpoenas
Use witnesses with personal knowledge. If a material witness or
record will not be provided voluntarily, examine Nevada’s current
subpoena procedure early enough to comply. Explain the specific fact the
evidence is expected to prove.
Notice and new issues
If the hearing moves to a materially different issue from the notice,
state the objection clearly and explain the preparation or evidence that
the lack of notice prevented. Ask for the relief permitted by current
Nevada procedure rather than proceeding silently and raising surprise
only later.
Closing
A useful closing is short: legal standard, decisive findings,
evidence supporting those findings, response to the strongest contrary
point, and requested result.
Preserve the record
Keep the exhibit packet, proof of submission, hearing notice, notes
of objections and rulings, and the decision-service record. These
materials are essential if Board or court review follows.
