Find the legal
issue controlling the appeal

The reason a job ended is not always the same as the unemployment
issue stated on the notice. Start with the agency’s issue, then test
whether the facts fit it.

Fired or discharged

Misconduct asks whether
work-connected conduct meets the state’s disqualification standard. Poor
performance, inability, mistake, and deliberate violation are not
interchangeable.

Quit, resigned, or
disputed separation

Voluntary quit asks who
actually ended the relationship and whether the reason for leaving
satisfies state law. Exact words and actions matter.

Medical,
transportation, childcare, or schedule limitation

Able and available asks
what work the claimant could and would accept, not only whether the
claimant could perform the former job.

Offered or recalled to work

Refusal of suitable
work asks whether there was a definite offer, whether the work was
suitable, and why it was declined.

Benefits already paid

Overpayments require examination
of the underlying eligibility decision, amount, fault rules, and any
repayment or waiver process.

Accusation of a false
statement

Fraud and
misrepresentation may turn on the exact statement, knowledge,
intent, materiality, and identity of the person who made it.

Account or identity
compromise

Identity theft should be
investigated separately from the claimant’s own eligibility and from a
generic fraud investigation.

Employer challenged an award

Employer appeals require the
claimant to prepare even when the initial determination was
favorable.

Appeal considered late

A timeliness dispute can prevent review of the merits. Preserve the
notice, service evidence, filing proof, barrier, and prompt action after
the barrier ended.
